Legal support of real estate contracts
If we analyze all transactions, then we can say with confidence that real estate transactions are the most dangerous for both parties.
There are so many fraudsters in the real estate market that everyone should provide themselves with qualified legal support before entering into a transaction.
Asking a person who has become a victim of a fraudster when buying and selling an apartment: "Why didn't they hire a lawyer or attorney to accompany this type of transaction?" They answered: "Why do I need a lawyer if everything was checked by a notary and certified my deal."
Of course, it cannot be denied that the notary checks:
- the presence of restrictions on the disposal or use of property;
- the presence of restrictions on the property, related to the mortgage;
- presence of litigation or interests of third parties;
- history of real estate;
- the powers of the parties to the transaction to alienate or acquire real estate, their legal capacity.
However, it should be remembered that neither the notary nor the realtor is engaged in checking the legal purity of the acquired property or the good faith of the buyer or seller you have found. Moreover, they do not even have such powers.
Over the past 2 years, the lawyers of our association have suspended the execution of real estate transactions more than 20 times for various reasons.
The most common reasons for this were the issuance of court decisions regarding the real estate being sold or purchased, which was not included in the register, therefore, neither the notary nor the realtor could know about their existence. Often banks in litigation do not enter the decision on the mortgage in the register, and when the property is sold, they foreclose on the property of the new owner.
By refusing the help of a lawyer specializing in real estate transactions, when concluding a transaction, you can:
- transfer the deposit to the seller who has nothing to do with the alienated property;
- become the owner of illegally built or reconstructed property, etc.
SERVICES:
- verification of documents on ownership of the property;
- verification of property owners;
- checking the availability of court decisions concerning the property or its owner;
- checking the availability of communications and documents for them;
- checking whether the property is in a mortgage;
- if this is an apartment located in a building that has not been put into operation - checking the developer's documents and the availability of all technical conditions for communications, the purpose of the land on which the house is located.
