Permanent residence permit in Ukraine
Foreigners and stateless persons wishing to emigrate to Ukraine, and have the right to do so, in accordance with the norms of the current legislation, issue a residence permit in Ukraine. This document gives a person the right to reside on the territory of Ukraine without any restrictions.
To obtain a residence permit, you must definitely obtain an immigration permit.
To enter Ukraine, you need to obtain an immigration permit. This permit is issued only within the Kovta for immigration approved by the Cabinet of Ministers of Ukarina.
An immigration permit outside the immigration quota is granted:
1) to one of the spouses, if the other spouse with whom he has been married for more than two years is a citizen of Ukraine, children and parents of citizens of Ukraine;
2) to persons who are guardians or trustees of citizens of Ukraine or who are under the guardianship or custody of citizens of Ukraine;
3) persons entitled to receive the Ukarina citizenship by territorial origin;
4) persons whose immigration is of state interest for Ukraine;
5) overseas Ukrainians, spouses of overseas Ukrainians, their children in the event of their joint entry and stay on the territory of Ukraine.
TO OBTAIN AN IMMIGRATION PERMIT, IT IS NECESSARY:
- application form;
- translation of pages of a passport document in Ukrainian with personal data of a foreigner and pages with a Ukrainian visa (if any), registration at a checkpoint across the state border (immigration card), extension of the line of stay in Ukraine, notarized;
- a photocopy of the passport of the relatives to whom the foreigner arrived;
- notarized copies of documents certifying close family relations with citizens of Ukraine;
- a photocopy of the check on the absence of a criminal record on the territory of Ukraine;
- a certificate issued by the competent authorities of the state of previous residence or its diplomatic representative or consular office in Ukraine on the absence of a criminal record;
- certificate from the place of residence abroad (or a list of disposal);
- a notarized statement of the consent of the owners and co-owners for permanent residence and the registration of a foreigner in their living space;
- 4 photos 3.5X4.5;
- receipt of payment for SMS services (179 UAH 74 kopecks);
- a document issued by a medical institution stating that a person is not a patient with chronic alcoholism, substance abuse, drug addiction or infectious diseases, certificate No. 028 / O on the absence of pathogens of infectious diseases in the person;
- statement of consent to immigration for financial security not lower than the subsistence level in Ukraine.
The territorial body of the SMS must issue a residence permit if there are no grounds for refusing to issue a residence permit.
The territorial body of the SMS must refuse to issue a residence permit in the event that:
1) a foreigner or stateless person has a residence permit or a temporary residence permit (except for cases of exchange of a residence permit or registration of a residence permit for a foreigner or stateless person temporarily residing on the territory of Ukraine on the basis of a temporary residence permit), a refugee certificate or identity card of the person who has been granted subsidiary protection, which is valid on the day of application;
2) a foreigner or stateless person is staying on the territory of Ukraine in violation of the established line of residence or an unfulfilled decision of an authorized state body on forced return, forced expulsion or entry ban is in force against them;
3) the data obtained from the databases of the Unified State Demographic Register, card files, do not confirm the information provided by the foreigner or stateless person;
4) it has been established that the person is a citizen of Ukraine;
5) a legal representative who does not have documented authority to obtain it has applied for a residence permit;
6) a foreigner or stateless person is not provided in full or in violation of the terms provided for in paragraphs 17-19 of the Procedure for registration, issuance, exchange, cancellation, forwarding, withdrawal, return to the state, invalidation and destruction of a residence permit approved by a resolution of the Cabinet of Ministers Ukraine dated 25.04.2018 No. 321, documents and information required for registration and issuance of a residence permit;
7) information received from the National Police, the Security Service of Ukraine, another state body that the actions of a foreigner or stateless person threaten national security, public order, health, protection of the rights and legitimate interests of citizens of Ukraine and other persons living in Ukraine, as well as if a foreigner or a stateless person has committed a crime against peace, a war crime or a crime against humanity, as defined in international law, or is wanted in connection with the commission of an act that, in accordance with the laws of Ukraine, is recognized as a serious crime;
8) a passport document of a foreigner or a document proving the identity of a stateless person is forged, damaged or does not conform to the established model or belongs to another person or its validity period has expired;
9) it has been established that a foreigner or stateless person has provided deliberately false statements, forged documents, or it has been established that the immigration permit granted to them has been canceled;
10) the fact of non-compliance by a foreigner or stateless person with a decision of a court or state bodies authorized to impose administrative charges has been revealed, or they have other property obligations to the state, individuals or legal entities, including those associated with a previous expulsion from Ukraine, including after the expiration of the term prohibition of further entry into Ukraine;
11) in other cases provided by law.
Period of validity of the residence permit
A residence permit is issued for 10 years. A residence permit without a contactless electronic medium is subject to exchange in connection with reaching the age of 25 and 45.
